Australia Domain Names will submit your domain domain name as soon as your order is submitted online for approval along with the domain application fee ( when it has cleared using the online Domain PayPal shopping cart ). This should take no more than 24 hours ( working days ).
All other customers who have paid by Invoice will have their domain names forwarded for approval when these funds have cleared.
We will contact you by e-mail when your Domain application has been approved. If is has been denied please see point 9.0 below

2.0 USE OF THE WHOIS SERVICE. |

THE USE OF THE WHOIS SERVICE is subject to the following terms. If you do not agree to these terms you may not use this Whois service. You may not use the Whois service:
a) to allow, enable or otherwise support the transmission of unsolicited communications to any person, by any means;
b) using an automated electronic query process;

3.0 REGISTRANT'S OBLIGATIONS |
|
|
Throughout the Term of the Registrant Agreement with Australia Domain Names, the Registrant must
By submitting this application for a domain name, you confirm that you are eligible to hold the domain name set out in this application, and that all information provided in this application is true, complete and correct, and is not misleading in any way. If any of the information is later found not to be true, or is incomplete, incorrect, or misleading in any way, or if you have submitted this application in bad faith, the domain name licence can be cancelled and you can permanently lose the use of the domain name
Give notice to the Registry Operator, through the Registrar, of any change to any information in the Registrant Data.
Must not, directly or indirectly, through registration or use of its Domain Name or otherwise.
*Register a Domain Name for the purpose of selling it;
*Register a Domain Name for the purpose of diverting trade from another business or web site;
*Deliberately register misspellings of another entity's company or brand name in order to trade on the reputation of another entity's goodwill.
*Register a Domain Name and then passively hold a Domain Name Licence for the purpose of preventing another registrant from registering it.
The Registrant must not in any way:
* transfer or purport to transfer a proprietary right in any domain name registration;
* grant or purport to grant a registered domain name as security,
*
encumber or purport to encumber a domain name registration.
Australia Domain Names does not represent or warrant the availability or registrability of any domain name to the Customer. The Customer agrees that it will have no rights or cause of action against Australia Domain Names if a domain name cannot be registered.
Any act or commission by the Customer in respect of an actual and/or attempted registration of a domain name prior to notification by Australia Domain Names occurs at the sole risk of the Customer.
Australia Domain Names will not at any time, assume any liability whatsoever in respect of the use by the Customer of any domain name.
Any disputes arising must be resolved between the parties involved
In the event of a dispute, Australia Domain Names will not be obliged to become involved, or take part, in a dispute but may, in its sole and absolute discretion:
(a) withhold or suspend a domain name; and or
(b) make written representations it deems fit to the Registry

4.0 TRANSFERS - DOMAINS |
|
|
Transfer from Australia Domain Names.com.au
Once a Domain has been registered through Australia Domain Names- one must keep it for a min of 6 months. If you want to transfer the Domain to another Domain Registrant then there will be a $150.00 fee charged to release this domain name to the new provider.
The Customer must not transfer a domain name to another Internet service provider unless it has first satisfied all Australia Domain Names accounts in full including Hosting and Website payments.

5.0 TERMINATION OF HOSTING . |
|
|
Australia Domain Names may suspend or terminate access to the Hosting Services without notice to the Customer if the Customer account becomes overdue. Australia Domain Names will not be responsible for any loss or damage to the Customer or any other party as a result of such suspension or termination

6.0 NOTICES TO CUSTOMERS |
|
|
The Customer acknowledges that all rules and regulations which apply to domain name registration must be strictly construed and applied. The Customer accepts sole responsibility for ensuring compliance with all relevant laws, rules and regulations in this respect. The Customer agrees that it is solely liable for ensuring that all Customer details on registered domain records remain current. Australia Domain Names will not be held liable for any loss or damage arising from interruption to Services that occur as a result of Customer non-compliance with the matters including obsolete contact details.
The Customer shall remain solely responsible for renewing a domain name. The Customer will not hold Australia Domain Names liable for any downtime, loss or damage suffered as a result of non-renewal or expiry of a domain name by the Customer.
Australia Domain Names will not reimburse or otherwise compensate the Customer for payments made by the Customer to third parties for domain name renewals
If Australia Domain Names has been informed of illegal content stored under the Customer's domain name/user web, it will immediately request the Customer remove the data forthwith. If compliance with this notice is not achieved within 24 hours, Australia Domain Name will be entitled to immediately terminate this agreement...non-refundable

7.0 IF DOMAIN EXPIRES ? |
|
|
If Letting your Domain Name Expire or from non payment will result in the Domain name going into Redemption or Escrow. The retrieval of Domain from this Redemption Period will have a fee determined by the company that is holding the domain name.
Australia Domain Names is not responsible for Domain Name Redemption. Please register your Domain Name before expiration date.

8.0 NO REFUNDS OR LIABILITY FOR MISSPELLS |
|
|
When your Domain Name has been submitted for Registration, a Domain Registration confirmation e-mail will be sent to you by Australia Domain names with the domain order details being processed.
Please check for errors
If you do not respond to this e-mail pertaining to any errors within 24 hours regarding
a) domain name being incorrect
b) the registrant names being incorrect
then Australia Domain names cannot be held liable for the incorrect domain order going through. Please check carefully that the Domain order is correct.

9.0 PARTIAL REFUNDS ONLY FOR. COM.AU/NET.AU - IF A VALID ABN OR ACN NO IS NOT SUPPLIED.

If a Valid ABN/ACN is NOT supplied with this application FOR .com.au/.net.au Business Domains, it will be denied and there will be a partial refund of:

a ) Minus an REFUND Admin Fee of
AUD $20.00
b) Minus the ' on that day ' transfer PayPal fee
within 14 working days of said Domain application.

10.0 DOMAIN ADMINSTRATION CHARGES |

11.0 INDEMINITY |
|
|
The Customer agrees to indemnify and hold harmless Australia Domain Names and its employees, contractors, agents and directors in full against any and all liabilities, claims, losses, damages, penalties, actions, judgments, suits, costs or expenses of any kind arising under these terms and conditions, including from the use by the Customer of any intellectual property rights of any third party and the registration or use of domain names by the Customer.

12.0 DOMAIN DISPUTES |
|
|
auDA currently has in place a dispute resolution policy called auDRP (the .au Dispute Resolution Policy) which applies in the event of disputes between a registrar and a registrant, or between a registrant and a third party, in relation to entitlements to domain names in .au. The auDRP binds the Registrar and the Registrant as if it were incorporated in the Registrant Agreement.
The Registrant acknowledges that auDA may develop and implement other dispute resolution policies which are accessible by the Registrant as an alternative and further to any complaints handling procedure prescribed by the Registrar. Such policies bind the Registrar and the Registrant as if they were incorporated in the Registrant Agreement.
The Registrant warrants that it meets, and continues to meet, the eligibility criteria prescribed in auDA's Published Policies for registering a Domain Name. In the event that the Registrant ceases to meet such eligibility criteria, the Domain Name Licence may be terminated by either the Registrar or auDA.
The Registrant must not pursue any claim against auDA, and auDA is not liable for any direct, indirect, special, punitive, exemplary or consequential damages, including but not limited to damages resulting from loss of use, lost profits, lost business revenue or third party damages arising from any breach by the Registrar of its obligations under the Registrant Agreement or the Registrar Agreement between auDA and the Registrar.
The Registrant agrees that auDA is not responsible for the use of any Domain Name in the Registry database and that auDA is not responsible in any way for any conflict or dispute with or any actual or threatened claim against a Registrar or Registrant, including one relating to a registered or unregistered trademark, a corporate, business or other trade-name, rights relating to a name or other identifying indicium or of an individual or other intellectual property rights of a third party or relating to the defamation or unlawful discrimination with respect to any other person.
Notwithstanding any other provision of this document and to the fullest extent permitted by law, auDA will not be liable to the Registrant for consequential, indirect or special losses or damages of any kind (including, without limitation, loss of profit, loss or corruption of data, business interruption or indirect costs) suffered by the Registrant as a result of any act or omission whatsoever of auDA, its employees, agents or sub-contractors. Nothing in this document is intended to exclude the operation of Trade Practices Act 1974.
auDA means .au Domain Administration Limited ACN 079 009 340, the industry self-regulatory body responsible for administering domain names with the .au suffix.

13.0 AUSTRALIAN BUSINESS DOMAINS- .COM.AU and .NET.AU - REGISTRATION RULES. |
|
|
If you want to register an Australian Domain Name .COM.AU and .NET.AU , these rules will apply. During the registration process, you will be required to meet the following requirements.
COME.AU/ .NET.AU
1. To be eligible for a domain name in the com.au/.net.au, registrants must be:
Provide a Australian Valid ABN or ACN Number and be
a) an Australian registered company; or
b) trading under a registered business name in any Australian State or Territory; or
c) an Australian partnership or sole trader;
d) a foreign company licensed to trade in Australia; or
e) an owner of an Australian Registered Trade Mark; or
f) an applicant for an Australian Registered Trade Mark ; or
g) an association incorporated in any Australian State or Territory; or
h) an Australian commercial statutory body
2. Domain names in the com.au/net.au 2LD must:
a) exactly match, acronym or abbreviation of the registrant’s company or trading name, organization or association name or trademark
b) be otherwise closely and substantially connected to the registrant

WHAT CHARACTERS CAN BE USED IN DOMAIN NAMES? |

The valid characters for use in a all domain name are:

They must be between 1 and 63 characters long not including the four characters
used to identify the TLD such as .com. or .net

They can be made up of letters or numbers.
